ISLAMABAD: The special court on Thursday resumed its hearing of the treason case against the former military ruler Gen (retd) Pervez Musharraf, DawnNews reported.
The three-judge court headed by Justice Faisal Arab resumed the hearing of the case during which Pervez Musharraf’s lawyer Anwar Mansoor said that the application (terming the summons for Musharraf as unlawful) was filed to rectify the decision as it earlier mentioned that the accused did not want to appear before the court.
Mansoor added that his client wanted to appear in the case proceedings but due to certain reasons he could not appear before the court.
To which Justice Arab responded that if it is said the accused did not want to appear before the court due to security concerns it implied that he did not intend to appear.
Musharraf's lawyer Mansoor said that he had stated in the application that he would need time to get advice from his client in this regard.
On the other hand, prosecutor Akram Sheikh while citing a newspaper reference offered to detach himself from the hearing on the condition that Musharraf appears in the court.
Upon which Justice Arab told Akram Sheikh that the issue was of personal nature rather than judicial and the court would not take it into consideration.
Anwar Mansoor in his arguments said that the role of a prosecutor was not to seek punishment but to assist the court.
On March 14, Mansoor had contended that orders issued by the court to summon Musharraf were unlawful, adding that the Dec 13 order was also unlawful.
He had then requested the court to revisit the order.
